Games maker Square Enix, in the takeover offer they extended to Tecmo Games, outlined a lack of optimism for Tecmo’s future.

Their hold-up? Lawsuits by developer Tomonobu Itagaki for unpaid bonuses and by employees Hiroaki Ozawa and Tatsuki Tsunoda (on behalf of all Tecmo employees) for unpaid overtime.

That has now changed. Tecmo announced they have settled the lawsuit over unpaid overtime. The suit was filed June 2008, with the employees asking for 8.3 million yen ($77,000).

The suit claimed that the company implemented a “flexible hours” setup that neglected to pay employees for overtime, which could be over 100 hours a month.

Financial terms of the settlement were not disclosed.
